It's Legal to Bid on Your Competitor's Name
In a recent post, WebProNews suggested bidding on your competitor's name, but being ready to comply if you received a "legal letter." Now it seems that you might not have to worry about those "legal letters" for a little while. Eric Goldman reports:
The keyword advertising legal roller-coaster continues. Last time I blogged on the matter in the Buying for the Home case, I indicated that plaintiffs and defendants traded wins in 2006. [...] Even though this case didn't quite fit the pattern, this is a big win for advertisers. The court holds that, as a matter of law, the use of keyword-triggered ads and keyword metatags cannot confuse consumers if the resulting ads/search results don't display the plaintiff's trademarks.
Granted, as Goldman suggests, this is probably far from over. For the meantime, however, bidding on your competitor's name may prove more lucrative than libelous.
